1. Agreement to Terms
These Terms of Service ("Terms") are a legally binding agreement between you ("User", "you") and Conversion Console ("we", "us", "our", "the platform"), governing your access to and use of conversionconsole.com and all associated software, features, and services (collectively, the "Service").
Conversion Console is a software-as-a-service platform providing SEO, AIO, PPC, and CRO analytics and marketing automation. By creating an account, connecting third-party API credentials, or otherwise accessing the Service, you agree to these Terms. If you do not agree, you must not use the Service.
2. Account registration and responsibilities
- Account security: You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly at [email protected] if you suspect unauthorized access.
- Authorized representative: If you use the Service on behalf of a company, client, or other entity, you represent that you have authority to bind that entity to these Terms.
- Accurate information: You agree to provide accurate, current, and complete registration information and keep account details up to date.
3. Third-party API integrations
The Service relies on third-party application programming interfaces and platforms ("Third-Party Services"), including but not limited to Google Ads, Google Analytics, Google Tag Manager, Google Search Console, Meta Ads, Microsoft Clarity, and Microsoft Bing Webmaster. Features you enable may read from or write to those services using credentials you authorize.
- Third-party terms: Your use of integrated features is also subject to the terms, policies, and API rules of each Third-Party Service. By connecting integrations, you agree to comply with applicable provider terms, including Google's Terms of Service and API policies where relevant.
- Availability and changes: We are not responsible for interruptions, data delays, inaccuracies, deprecations, quota limits, or policy changes caused by Third-Party Services beyond our reasonable control.
- Credential revocation: You may disconnect Third-Party Services in Conversion Console or revoke access through the provider's account security settings at any time.
4. Acceptable use and restrictions
You agree not to:
- Reverse engineer, decompile, or attempt to extract source code from the Service except where prohibited restrictions cannot be waived by applicable law.
- Use automated scraping, bots, or unauthorized access methods to extract data from the Service or bypass rate limits.
- Attempt to bypass security controls, authentication, or owner-scoped workspace boundaries.
- Use the Service for illegal, unauthorized, or fraudulent marketing, tracking, or data-processing activities.
- Interfere with or disrupt the integrity, performance, or availability of the Service or related infrastructure.
5. Service availability, subscriptions, and modifications
- Modifications: We may modify, update, suspend, or discontinue any feature or functionality of the Service. We will provide reasonable notice for material changes that adversely affect paid features when practicable.
- Availability: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We strive for reliable uptime but do not guarantee uninterrupted access.
- Fees: Paid plans, if applicable, are described on our pricing page. Fees are non-refundable except where required by law or stated in a separate agreement.
6. Intellectual property
Conversion Console and its software, workflows, design, documentation, and branding remain our property or that of our licensors. You retain ownership of your business data, client content, and credentials you submit to the Service, subject to the license needed for us to host and process that data to provide the Service.
7. Disclaimers and limitation of liability
To the maximum extent permitted by applicable law, the Service is provided without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, Conversion Console and its directors, employees, contractors, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity, arising from or related to your use of the Service or Third-Party Services.
To the maximum extent permitted by applicable law, our total aggregate liability for claims arising out of or relating to the Service in any twelve-month period shall not exceed the greater of (a) the fees you paid to Conversion Console for the Service in the twelve months before the claim arose, or (b) one hundred United States dollars (USD $100) if you have not paid fees in that period.
Some jurisdictions do not allow certain warranty disclaimers or liability limitations; in those cases, the above limits apply to the fullest extent permitted.
8. Termination
You may stop using the Service at any time by disconnecting integrations and, if desired, requesting account deletion as described in our Privacy Policy.
We may suspend or terminate your access immediately if you breach these Terms, if required by law, or if continued provision poses security or legal risk. Upon termination, your right to use the Service ends; provisions that by nature should survive (including disclaimers, limitations of liability, and governing law) will survive.
9. Governing law
These Terms are governed by applicable commercial and contract laws, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be resolved in courts of competent jurisdiction, except where mandatory consumer protection laws in your country require otherwise.
